Smith Wins ‘Zack and Miri’ Appeal
According to an AP report in USA Today, Kevin Smith has won his appeal with the MPAA over Zack and Miri Make a Porno. The previously NC-17 rated comedy will now carry an R rating. Once they make a decision, I was under the impression the MPAA rarely budges so this is good news.
Zack and Miri stars the increasingly ubiquitous Seth Rogen and the delightful Elizabeth Banks as two best friends who decide to earn their way out of date making adult movies. It opens on October 31.

well i think they budge when potentail large/large company release/if it’s known product…
that’s how the novce…yes that would be me/thought that’s how it happened….
Either USA Today updated their article or I didn’t read far enough the first time because they kind of proved me wrong:
“It was the third time Smith successfully talked his way down to a lower rating: His 1994 debut Clerks initially received an NC-17 rating that was reduced to an R on appeal, while his 2003 film Jersey Girl was reduced to PG-13 after first being rated R.”
My understanding of the MPAA — limited mostly to the documentary a few years back — is that the board adjusts ratings fairly regularly, but usually after some sort of editing compromise has been made with the filmmakers.
Banks may be delightful, but Rogen has a curious appeal, as well. I hope they don’t edit out his bits.
In this case, Smith edited 2 or 3 times, still came back with an NC-17 so he appealed the ruling with no further changes and they caved in.
